Auction Rules
- All dealers buying or selling must be registered through our office. All dealers are required to use Buyers Card and wear a dealers badge.
- All drivers must wear a drivers badge to be on premises.
- No retail customers allowed. YOU MUST BE A LICENSED AND REGISTERED DEALER TO BUY OR SELL. Children on the premises concerns us greatly. Do not bring children to this auction. Also, due to the congestion in the barn during the sale day, we ask dealers to ensure that drivers limit their time in the sale barn so as to allow buying and selling dealers more space.
- Clarksville Auto Auction acts solely as an agent and is not a party to any contracts for the sale of any motor vehicle sold at auction.
- All vehicles must be paid for the day of sale. NO EXCEPTIONS.
- There will be ABSOLUTELY NO OUTSIDE SALES. All cars must run across the block and all transactions must clear through the offcie. Disregard of this rule is grounds for termination of business.
- Dealers must turn in titles and sign odometer statements on auction block at the time of sale or they will be sold TA.
- Dealers must announce title attached vehicles at the time of sale and produce a reassignable title to the office within 30 days of date vaehicle sold, or buyer had the option of returning the vehicle.
- After 30th day, if seller presents title before vehicle is returned to auction, the buyer will be required to keep the vehicle.
- This auction will not be responsible for any money spent on title attached vehicles nor will the auction hold the seller liable for any charges or expenses incurred on title attached vehicles that are returned.
- It is the sellers' responsiblity to ensure that a title is negotiable in the buyer's state.
- This auction will not be held responsible for mileage on any vehicle.
- All vehicles over 100,000 miles are "as is," unless seller rides and drives the vehicle on themselves, and initials R&D on the block.
- The auction does not warranty or guarantee odometer readings or odometer statements.
- Vehicles that are ten (10) calendar years old or older are mileage exempt and cannot be arbitrated for mileage, unless the seller makes a mileage statement that is untrue. Example: Seller states mileage is actual when in fact miles are over or true miles are unknown. Seller then forfeits their rights of exemption and subjects the vehicle to arbitration.
- All reserved numbers not cancelled by 2 p.m. Monday will be charged a $10.00 no show fee.
- No vehicle will be offered for sale without the V.I.N. plate attached in the designated area. This auction reserves the right to refuse any vehicle in which the identification plate appears altered in any way.
- Thoroughly check and test drive every vehicle before settlement. If there is a problem, a proper complaint must be filed with the arbitrator within one hour.
- All vehicles must be arbitrated or paid for within one hour.
- Dealer is responsible for any vehicle they are test driving.
- Dealers are asked not to remove keys from any vehicles on the consignment lot.
- This auction is not liable for vehicles left on lot. Sellers are advised to remove all personal property prior to checking vehicle in.
- Check your vehicle for antifreeze. This auction is not responsible.
- All vehicles selling for $1,500 or less are sold "as is." ALl vehicles selling "as is" cannot be rejected for a defect. You own the vehicle.
- If yellow light is on, there is an announcement on the vehicle. Please alert yourself. Yo uare responsible.
- No vehicle can be rejected for visible defects.
- All flood cars, reconstructed vehicles and frame damage vehicles must be announced.
- All RVs, boats, campers, motorcycles, kit cars, foreign cars, heavy trucks and miscellaneous other vehicles will be sold "as is." The auction does not guarantee year model or condition.
- Ride and Drive Guarantee must have $250.00 worth of repair to any one item to be rejected.
- No turn down or bushing for minor defects costing $250.00 or less.
- We will not be responsible for frame damage, flood cars, busted blocks, misrepresentation, police cars or diesel conversion AFTER A SEVEN (7) DAY PERIOD.
- Police, taxi and flood vehicles must be announced specifically and sold "as is."
- Auction makes no guarantee after car acceptance and/or leaves premises, ecept cracked blocks must be reported within three (3) days.
- We are not responsible for exchanges or promises regarding warranty books.
- Kentucky selling dealers are responsible for any and all delinquent Kentucky property tax on vehicles sold through this auction.
- On vehicles returned for any reason, the seller is responsible for auction sale fees.
- Any dealer refusing to honor a check to Clarksville Auto Auctionwill be barred from auction and reported to Auction Insurance Agency. All retruned checks will be charged a $25.00 return check fee.
